Rules, Terms & Conditions

TOWEL POLICY: We do NOT supply towels, please bring your own. Beach towels can be purchased from our gift shop.

MAKEUP POLICY: Private classes will receive 4 free make ups a year. They will expire 90 days from the date you missed. Any additional make ups will be $10.00. Swim team will be able to participate in a 15 minute one on one class for $10.00. These will expire 90 days from the date you missed.

DROP PROCEDURE: PARENTS MUST NOTIFY THE SCHOOL TO DROP A STUDENT FROM CLASS. Only a written notice via email, regular postal mail or hand delivered to our front desk. I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my ACH draft, or credit card account. I understand that a 30 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify Lori's H2O Skills, LLC in writing to drop my student from class(es).

Only those contacts listed in your account data will have access to information pertaining to the student(s) listed in your account.

REFUND POLICY: No refunds are available.

MEDICAL AUTHORIZATION: In the event of an accident or emergency I hereby authorize that I and/or my child(ren) be transported to a hospital for medical treatment and I hold Lori's H2O Skills, LLC and Affiliates and their representatives harmless in the execution of such. Additionally, I hereby agree to individually provide for all medical expenses which may be incurred by myself and/or my child(ren) as a result of any injury sustained while visiting or participating at or for Lori's H2O Skills, LLC.

PHOTO RELEASE: I am aware that Lori's H2O Skills, LLC and Affiliates, parents, grandparents, media or other parties may take photos or videos of my child and in consideration for my and/or my child(ren)'s participation at Lori's H2O Skills, LLC and Affiliates I hereby grant my permission for my and/or my child's image, likeness or name to appear in print, on the internet, in social media or other electronic or printed publicity or advertising.

LOST OR STOLEN ITEMS: Jewelry should not be worn while swimming. PLEASE LEAVE JEWELRY ARTICLES AT HOME. Lori's H2O Skills, LLC and Affiliates will not be responsible for ANY items that may be lost or stolen.

ARRIVAL AND PICKUP: Be sure your student arrives 5 minutes before his/her scheduled class time. Please pick up your student on time. Swim classes must begin and finish on time. Lori's H2O Skills, LLC's staff will teach your child(ren) his/her scheduled time. Please inform us if you know you will be late picking up your student. Instruct your student to wait inside the building and you should escort them from the building to your car. Please drive slowly and carefully through the parking lot and consider that our students may include young children. Do not take a chance on your student running to and from your car.

PERPETUAL WAIVER OF LIABILITY: In consideration of permission to use (today and on all future dates) the property, facilities, and services of Lori's H2O Skills, LLC, the undersigned participant and parent or guardian, on behalf of participant(s), personal representatives or assigns, do hereby release, waive, discharge, and convenient not to sue Lori's H2O Skills, LLC, its directors, officers, employees, volunteers, independent contractors, agents, and insurance carriers from liability for any and all claims including those arising from negligence of Lori's H2O Skills, LLC, or any of its aforementioned parties. This agreement applies to one 1) personal injury (including death) from accidents or illnesses arising from participation in Lori's H2O Skills activities including but not limited to organized activities, classes observation, and individual use of facilities, premises, or equipment: and 2) any and all claims resulting from damage to, loss of, theft of property.

INDEMNICATION AND HOLD HARMLESS: The undersigned Parent or Guardian further agrees to Hold Harmless, Defend, and Indemnify Lori's H2O Skills, LLC, from all claims arising directly or indirectly from participation of the participant at Lori's H2O Skills, LLC, including those resulting from negligence of Lori's H2O Skills, LLC. The undersigned Parent or Guardian further agrees to pay all costs and attorneys' fees incurred by Lori's H2O Skills, LLC, in investigating and defending a claim or suit arising from the participation of the Participant. The undersigned further expressly agrees that this agreement is intended to be as broad and inclusive as is permitted by law of the State of Ohio and that any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Likewise, the undersigned agree that if legal action is brought, it must be brought in District Court residing where the incident occurred or in the appropriate Federal Court in the State of Ohio.

Swimming activities, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another and include slips, falls, colliding with the wall, and being struck by another swimmer. These risks can result in injury ranging from 1) minor injuries such as scratches, bruises, and sprains to 2) major injuries such as loss of vision, joint injuries, concussions and heart attacks to 3) the very rare catastrophic injuries including paralysis and death. The undersigned Participant and Parent or Guardian hereby asserts that participation is voluntary and that the undersigned Participant and Parent or Guardian knowingly assumes all such risks.

ACKNOWLEDGE AND UNDERSTANDING: The undersigned Participant and Parent or Guardian have read this participant agreement and fully understand that we are relieving Lori's H2O Skills, LLC, from liability from injuries resulting from negligence of Lori's H2O Skills, LLC, and from the inherent risks of the activity. The undersigned understands that the Participant is relinquishing substantial rights, including the right to sue. The undersigned acknowledge that their signatures below are given freely and voluntarily, and intend the electronic signatures to be a completer and unconditional release of all liability to the greatest extent allowed by law in the State of Ohio.
